Order BEFORE: WEICK, MARTIN and JONES, Circuit Judges The petitioner, an inmate at the Southern Ohio Correctional Facility, appeals from the judgment denying his petition for a writ of habeas corpus. The appeal has been referred to a panel of this Court pursuant to Rule 9(a), Rules of the Sixth Circuit. After examination of the briefs and record, this panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. The district court entered judgment in this case on December 26, 1979. Seven days later, on January 2, 1980, the petitioner filed a timely motion to reconsider. Before that motion was decided, the petitioner filed a notice of appeal on January 28, 1980. The motion to reconsider was denied in an order of February 21, 1980. Nothing further was filed in the district court after that date.
